Frustrated by the Rock N Roll Jesus purveyor's failure to appear for a scheduled deposition last month, a Michigan judge on Wednesday threw out Rock's defamation lawsuit against a woman who once accused him of assaulting her.
"What's special about him?" Oakland County Circuit Court Judge Shalina Kumar asked Rock's attorney, William Horton. "Why does he get to violate a court's order?"
Horton told the court that his client had missed two depositions because of scheduling conflicts while touring and promoting his latest album, and reminded Kumar that he had suggested several November makeup dates.
Rock, whose real name is Robert Ritchie, sued Kozlowski in March, claiming she had defamed him, invaded his privacy and cast him in a negative light by filing a police report that accused him of pushing her headlong into a snowbank on the night of Mar. 8 after she refused to go home with him.
In his complaint, Rock alleged that Kozlowski became "verbally abusive and belligerent" after downing a few too many at the singer's Brandon Township home, where he invited her and several others after meeting them at a local bar.
"The suit is designed to, one, set the record straight that in fact the incident never happened and that this accuser will be found out in court," Rock attorney Michael Novak told E! Online at the time. "That's the first purpose so that the record clearly shows that Bob Ritchie does not assault women."
Meanwhile, Kozlowski's camp has an alternate theory as to why Rock went after their client in court.
"He likes publicity. He told Larry King all publicity is good publicity," lawyer Scott Norton told the Detroit News, which reported that Norton and his brother and co-counsel Drew Norton high-fived each other outside the courthouse after Kumar dismissed the suit. "Our expert witness will tell how our client has been devastated by this and the resulting publicity."
Kumar also entered a default in Kozlowski's countersuit against Rock, meaning the singer can't contest her lawsuit when it goes to trial Feb. 5, unless his camp chooses to appeal Kumar's decision.
No criminal charges were filed after authorities determined there was insufficient evidence against the rocker, but Kozlowski sued the 36-year-old Detroit native for assault and battery, intentional infliction of emotional distress and defamation. She is seeking at least $25,000 in damages.
Not harboring a grudge, however, is Tommy Lee, who did not press charges against his fellow artist after Rock punched him at the MTV Video Music Awards in September. Las Vegas prosecutors announced last month that they were dropping the case after Lee requested that they let bygones be bygones.
