Accused teacher out of jail

WALTHAM -- The trusted teacher and coach accused of assaulting students under the ruse of a Mafia-run massage business is free on bail, and will stay with a sister whose name and address will remain confidential.
    Robert Dacey, 49, had been ordered to wear an electronic ankle bracelet and be confined to his sister’s Flett Road home in Belmont by Waltham District Court Judge Gregory Flynn.
    Flynn set Dacey’s bail at $25,000 cash, and the conditions of his release during his arraignment Aug. 14.
    At the time, court records indicated the McDevitt Middle School teacher and Waltham High School coach, would live at 59 Flett Road in Belmont with his sister Mary O’Shaughnessy.


    Yesterday, family members posted Dacey’s bail in Waltham District Court, while his attorney, Dino Colucci asked Judge Tobin Harvey to amend the order of release to have Dacey live with another sister.
    Harvey agreed, and also granted a motion requested by Colucci that the woman’s name and address be impounded for privacy.
    A motion by Assistant District Attorney Elizabeth Dunigan to have the police report and the alleged victims’ contact information impounded was granted by Flynn during Dacey’s arraignment.
    Colucci declined to comment outside the courtroom yesterday.
    Family members also did not comment.
    District Attorney spokeswoman Emily LaGrassa said the conditions of release set by Flynn still apply. He must abide by any and all restraining orders against him, avoid alcohol, drugs and weapons, stay away from all schools, the alleged victims and their families, have no contact with children under the age of 16, and stay off the Internet.
    The unidentified sister told Harvey she would be responsible for her brother and would bring him to his court appearances.
    Court Probation Department officials said yesterday they would accompany Dacey home and fit him with the bracelet immediately.
    Dacey, who does not have a prior criminal record, was arrested at his Main Street home Friday, Aug. 11. He is not married and does not have children.
    He was placed on paid, administrative leave after his arrest, Superintendent Susan Parrella has said. She has declined further comment on the case.
    Dacey is charged with two counts of rape of a child, two counts of enticement of a child and indecent assault and battery on a person over 14. He has pleaded not guilty.
    Prosecutors allege Dacey assaulted two current male students and a former male student, who is now 21, by tricking them into coming to his house to help him train women who would then work in his friend’s Mafia-run massage business.
    Dunigan has said Dacey blindfolded the boys with duct tape and Ace bandages, before donning a wig and massaging them himself.
    She has said Dacey paid each of the boys $50 at the time, but has also been paying the older victim for his silence for years.
    District Attorney spokeswoman Melissa Sherman said she could not comment on how the alleged victim was paid.  [continue]
